Terms of Service
CONTRACT AND OVERVIEW
1. These Terms of Service govern the conditions under which you may access and use the Fasremit website, application, and services. By accessing, registering, and using our services, you agree to be bound by these Terms of Service. If you do not wish to be bound by these Terms of Service, you may not access, register, or use the services. If there are any changes to these Terms of Service, you will be notified, and such changes will not be applied immediately.
2. These Terms of Service are effective from the first time you access, register, or use the services. They may be amended from time to time, but any changes will only take effect two (2) weeks after you have received the updated Terms of Service.
3. The terms “Fasremit” and “we” in these Terms of Service refer to Fasremit, a non-bank financial company in Indonesia.
4. The term “you” in these Terms of Service refers to users and visitors of the Fasremit website and application.
5. For security reasons, we recommend that you send money only to people you know and trust. All fees displayed and charged comply with the principles of fairness and applicable laws.
6. We contract only with Users. We are not liable to any third party, including the recipient of a payment from a sender. If you are dissatisfied with our services, please contact our Customer Support. We will promptly handle your issue.
7. We will make every effort to deliver your money on time. However, delays may occur due to the following reasons:
a) Compliance with Anti-Money Laundering and Counter-Terrorism Financing regulations;
b) Situations involving instructions to recall your transaction;
c) Payments made after our cut-off times;
d) Downtime caused by Partners, internal systems, payout channels, or other parties;
e) Incorrect information entered in transaction details; and
f) Non-business days (e.g., holidays).
OUR OBLIGATIONS
1. You acknowledge that services may not be available in whole or in part in certain regions, countries, or jurisdictions. Currently, we only provide money transfers from Indonesia to other countries.
2. While we will make every effort to provide access to the website or application, we do not guarantee uninterrupted access due to technical or unforeseen issues.
3. For compliance purposes, we reserve the right to reject or not process certain transactions, or to limit transaction amounts, and we will notify you promptly if this occurs.
4. We will process transactions promptly, but some may be delayed or canceled as part of our verification, attempts to contact you, changes in operating hours, or other legal requirements.
5. We may send notifications related to transactions via email, messages, or other relevant communication methods. We will also provide updated information on our website or application.
YOUR OBLIGATIONS
1. To register and use the services, you must be at least 18 years old and have the legal capacity to enter into a binding contract under the laws of your jurisdiction.
2. You must not impersonate any person or entity, commit fraud, or attempt to conceal your identity.
3. You agree to pay us service fees and other related charges outside the transaction amount for each transaction you submit. Unless otherwise stated in these Terms of Service and the Refund Policy, service fees are non-refundable.
4. Regarding your registration and use of our services, you must provide:
(a) accurate personal or transactional data;
(b) updates to your personal information if there are any changes;
(c) information on at least one valid payment instrument, such as a bank account or debit card; and
(d) other identification documents we may require.
5. You are advised to use Fasremit only to send money to people you know and not to pay for goods or services from unknown or untrusted third parties. If you still choose to use the service for such purposes, you accept that we have no control over and are not responsible for the quality, safety, or delivery of such products. However, we will make reasonable efforts to assist you with the transaction.
6. You and the recipient must act for personal purposes. You must not send or receive transactions on behalf of a third party.
7. You must not act as a remittance business or provide remittance services while using Fasremit services. To do so, you must obtain a remittance license.
8. You must comply with these Terms of Service and all applicable laws, rules, and regulations when using the services. You are prohibited from using the services to send transactions to recipients who have violated these Terms of Service or for illegal activities, including but not limited to money laundering, fraud, and terrorist financing.
9. You are not permitted to:
(a) create more than one registration without our prior written consent;
(b) give others access to your registration details;
(c) refuse to confirm any information you have provided to us, including proof of identity, or refuse to cooperate in any investigation; and
(d) use anonymous proxies or tools designed to hide your activity when using our website or application.
OUR RIGHTS TO REFUSE, FREEZE, SUSPEND OR CANCEL
1. For legal and compliance reasons, we reserve the right to refuse, freeze, or suspend any verification, transaction request, payment request, or ongoing transaction at any time.
2. In the event we refuse, freeze, or cancel a transaction request or payment request, we may temporarily or permanently suspend your registration.
3. When we temporarily or permanently suspend your registration, or refuse, freeze, or cancel a transaction request, payment request, or transaction, we reserve the right to retain any service fees already incurred.
4. To comply with our obligations under applicable laws, we may request further information or evidence regarding the purpose of the transaction.
5. We reserve the right, at any time and without notice, to change or terminate the service or any part of the service.
6. We reserve the right to hand over your funds to the relevant authorities upon request.
YOUR RIGHT TO CANCEL OR REFUND
1. Once we have received your instructions, you do not have an immediate right to cancel a transaction. Instructions may be canceled if you notify us, but in some cases, requests may already have been submitted to the Service Provider and are non-reversible. Therefore, we cannot guarantee that cancellations will succeed. In such cases, we reserve the right to process or cancel your transaction, and you may be charged a reasonable cancellation service fee.
2. If you experience difficulties while using the service or discover an unauthorized completed transaction, please report it to us immediately and no later than seven (7) days from the transaction date. Refund requests must be submitted through the application or, if unavailable, by email with the user's full name, address, phone number, transaction tracking number, transaction amount, and reason for the refund.
3. You understand and agree that you are responsible for any losses resulting from unauthorized transactions, instructions, or other uses of the service where you have acted fraudulently or negligently. You also agree to release Fasremit and its affiliates from any losses, actions, or claims. However, we will take reasonable steps to process a refund if you acted negligently, and we may charge reasonable fees. Refunds will be credited back to the same payment instrument and currency used for the transaction.
INFORMATION COLLECTION
1. Customer Identification Program. All financial institutions in Indonesia are required by AML (Anti-Money Laundering) regulations to cooperate in combating money laundering and terrorist financing by collecting and verifying the identity of all customers. This is also explicitly stated in our Anti-Money Laundering Policy. Accordingly, we may legally obtain information about you and your recipient from various sources.
2. Verification and Checks. To validate your identification, we will verify your personal information. We may also need to validate the recipient’s identity. All information you provide will be kept confidential and secure. By accepting these Terms of Service, you authorize us to conduct necessary validations to verify the information. You must provide honest and accurate information when requested.
3. Data Privacy Policy. You agree that we may use your personal information for verification purposes. You also agree that we may use your data for communication, legal purposes, accounting, and record-keeping, in line with Fasremit’s Privacy Policy. By accepting this, you acknowledge that you have read Fasremit’s Privacy Policy.
4. Government-Mandated Disclosure. As described in our Data Privacy Policy, we may be required by law to provide your information, use of services, and instructions to government or other competent authorities. You acknowledge and agree that we may do this. Please note that we will not share your information except as explained in these Terms of Service.
INTELLECTUAL PROPERTY RIGHTS
We, our affiliates, or in some cases third parties, own the Fasremit website, application, and services, including all Intellectual Property Rights such as copyrights, patents, database rights, trademarks, and service marks.
WARRANTIES AND LIABILITIES
1. If we are proven to have breached these Terms causing users to suffer losses, we will make every effort to reimburse the transaction amount and service fees to the user.
2. Any compensation or claims you make must be supported by relevant documentation.
3. If you suffer losses not covered under claims mentioned in Section 2, our liability is limited to: (a) the service fee amount, and (b) up to IDR 1,000,000, unless agreed otherwise in writing. Our liability is limited to losses arising from a single transaction or related series of transactions. This means if you suffer losses due to our failure in two unrelated transactions, you may claim up to IDR 2,000,000.
4. In processing your transactions, we are not responsible for:
a) Any failure to carry out services (e.g., your instructions) due to unusual and unforeseeable events or communication system failures beyond our control;
b) Errors on the site, application, or services caused by you or third parties providing incomplete or incorrect information to us.
5. You agree that when completing transactions with Fasremit, no Fasremit affiliate or employee has a personal interest with you. Affiliates or employees act only as representatives of Fasremit, and services are provided on an “as-is” basis.
APPLICATION USAGE
1. We grant you a non-exclusive, non-transferable license to use the site or application subject to your compliance with these Terms of Service, the Privacy Policy, and applicable application requirements (all incorporated herein by reference), which may change from time to time. All rights remain with us.
2. You agree that, unless explicitly stated in these Terms of Service or permitted by law, you must not:
a) Duplicate the site or application (except where required for backup or operational security purposes); and
b) Rent, sublicense, loan, edit, translate, merge, adapt, alter, or modify the site or application in any way.
3. You understand that the site and application are not designed to meet your personal needs. No conditions, warranties, or requirements of any kind are provided in this regard. You are responsible for ensuring that the features and functions of the site or application meet your needs.
In particular, but without limitation, we accept no responsibility for losses incurred by you or third parties caused by delays in processing instructions or refusal to conduct transactions in accordance with these Terms of Service, related to AML regulations.
To comply with Bank Indonesia regulations, we are required to return funds temporarily placed with PT Fas Remit if unused in your account. All costs related to such refunds are your responsibility.
Refunds will be made to your primary bank account. Losses arising from non-receipt or misdirected funds due to your error or account issues are not our responsibility. However, we will make reasonable efforts to assist you.
Refunds can only be made if the temporary placement exceeds Rp10,000 (ten thousand rupiah).
Regarding your use of the site or application, we will not be liable, to the fullest extent permitted by law, for:
a) Any failure to perform services, loss, or delays in message delivery due to circumstances beyond our control or legal obligations;
b) Damage or disruption to communication facilities beyond our control that may affect accuracy or timeliness of messages;
c) Errors caused by incomplete or incorrect information provided by you or third parties;
d) Any losses resulting from using our application on “jailbroken”, “rooted”, or modified devices.
ELECTRONIC COMMUNICATIONS
1. You acknowledge that these Terms of Service may be agreed to digitally and that the following categories of information (“Communications”) may be provided electronically:
a) These Terms of Service, including any changes, modifications, or additions;
b) Your records (e.g., transactions) through the service;
c) Any disclosures or notices required by law or otherwise related to the service;
d) Any communication with Customer Support, including error claims or unauthorized usage; and
e) Any other communication related to Fasremit services.
2. You must promptly notify us of any changes to your email address or phone number by updating your profile at www.fasremit.com
To provide the best service, identity verification and transaction reviews may be conducted daily, including public holidays. You consent to us contacting you if necessary. If you do not agree, please contact Customer Support.
TERMINATION OF SERVICE
1. We may terminate these Terms of Service and our services immediately if you:
a) Become bankrupt, or we reasonably believe you are likely to be declared bankrupt;
b) Breach any provision of these Terms of Service;
c) Use the service in a way that disrupts other users or harms our reputation;
d) Breach or attempt to breach site security (including unauthorized access, data deletion, disruption, reverse engineering, spamming, hacking, or introducing viruses or malicious programs); or
e) Use the service in connection with fraud, illegal or unethical activities, or allow third parties to do so.
2. You may close your account through the Fasremit site or application. Before closing your account, note:
a) Account closure will result in forfeiture of vouchers and affiliate balances (if any);
b) Ensure there are no ongoing transactions, refunds, or withdrawals;
c) Closure of one account does not affect others;
d) Closed accounts with a transaction history may be reactivated at least 7 days after closure.
COMPLAINTS
1. If you have any questions or complaints regarding Fasremit services, please send them to the address listed on our site or via email.
2. We will confirm receipt of your complaint within 1 business day, and within 5 to 20 business days we will investigate and update you on the results or resolve your complaint.
GENERAL
1. Governing Law: This agreement is governed by Indonesian law and subject to the exclusive jurisdiction of Indonesian courts.
2. No Waiver: Failure by Fasremit to enforce any right or provision of these Terms does not constitute a waiver.
3. Modifications: We may update these Terms of Service and notify you of changes unless prohibited by law. You can review the latest version anytime on our website. If you continue to use the service after modifications take effect, you accept them. You may stop using the service if you disagree.
4. Entire Agreement: This agreement constitutes the entire agreement between the parties, replacing all prior understandings. By using our services, you agree this clause binds us, you, and the recipient under Indonesian Civil Code Article 1338.
5. Severability: If any provision is deemed invalid, the remaining provisions remain in effect.
6. Language: These Terms are written in both Indonesian and English. The governing language is English. In case of conflict, the English version prevails.
7. Third-Party Links: Any external third-party links are provided for convenience only. We do not control and are not responsible for their accuracy, legality, or content. You access them at your own risk.
8. Intellectual Property Rights: By using our services, you are granted rights to use them in accordance with these Terms. All elements of the site or application are protected intellectual property owned by us and/or our suppliers.
SECURITY
At Fasremit, we take security very seriously and strive to ensure your information remains safe. Fasremit allows you to send money to trusted friends, family, business partners, and individuals online. However, we strongly advise you to think carefully before sending money to strangers. Offers that seem too good to be true should be avoided as they may be scams. Please forward any suspicious “phishing” emails you receive claiming to be from Fasremit to our Customer Support.
